Jason’s Deli

On May 15 of last year, I was contacted by Carrie Woodward of Brains on Fire for a marketing campaign for Jason’s Deli.  In a series of email exchanges, Carrie/Kari offered me Jason’s Deli gift cards in exchange for the rights to use five of my pictures in their marketing campaign.  I never received said gift cards and subsequent emails to Carrie/Kari were ignored.  Recently, a number of our friends have indicated seeing the pictures featured on the Jason’s Deli web site.  In the center of the page, on the bottom, there’s a picture of my sister.  If you click on the pictures, it takes you to the Jason’s Deli Flickr page with 28 pictures, five of which are mine.  There’s no reason to question my claim, since all five pictures have been on my Flickr page for quite some time.  Just to drive the point home, however, you can find my name featured in the EXIF data of 3 of my pictures under the field “Owner Name”.  Granted, I never expected to make money off of any of my pictures on Flickr - that was never the intent.  They did, however, offer me a gift card in exchange for the rights to use my pictures.  So, since they offered, I’d really like to have my gift card.  Not sending me a gift card must be some sort of breach of contract or something, right?

I’m very sorry that your never received your gift certificate. I did not mean to overlook you or breach a contract. We truly appreciate you letting us display your pictures on the Jason’s Deli website.
I want to make this situation right. Please email your contact information and I will have a gift certificate in the mail today.
Sorry for the oversight and thank you for bringing it to my attention.

Sincerely,
Carrie Woodward
